Egroups is in business to make money, just like all the other free services
that are out there so I assume they can put the ads wherever they want... I
personally signed up with ListBot and paid the $99 to have AD FREE
newsletters.  That way, I control what my readers see.  $99 is not a lot of
money and you are able to send 5000 emails per month with the ability to
purchase more credits. So far, it has worked well and we are please with the
results.
