What I did as a result of a similar problem with Topica was get off Topica and move my list to a more publisher-friendly server - a PAID one. I do not know if that is a viable option for you, but I would think with that large a list, $20 or $30 USD a month should not be too big a problem.
As far as contacting your subscribers, I'd say most definitely. And make sure they understand that the problem is with Topica and their refusal to be more cooperative.
