I think the real issue is... "Is the publisher knowingly 
sending mail to people who didn't request it?"

If so, failure to let people "opt out" is irrelevant, IMNSHO.

I'm assuming you meant something other than what you literally 
wrote. Taken literally, your comment would mean that you'll 
accept spammers, as long as they "honor removes."
