[epub] "legitimate email marketers"

In a recent List-News, I saw the phrase "legitimate email marketers."
Can someone define that for me? In my mind, unless you have permission
from the recipient to send them emails, you are spamming. Is there some
other interpretation of this phrase that the industry uses to call
spamming "legitimate email marketing," or are they playing fair with the
term?
