Things are a little different globally than across many States in the USA...

In Australia and other places, these spam laws do not yet apply in the same
way, maybe that's why the web spam is still growing out this way......

There is some difference between emails sent commercialy as a B2B email
(strict commercial emails between corporate identities) and blanket mass
emails of a general nature between non commercial operators to unsolicited
email accounts of the general public.

This means a separation of the rules that allow the flow iff commercial
email soliciting advice and interest between companies being seen as fine
and part of the nature of doing business... The other is unsolicited to
unsuspecting parties that may need protection.

It would also be difficult see that many emails for HGH, medicines, penis
and breast enlargements, access to porn sites, online prostitution, and
other dross and detritis than appears in emails could be seen as legitimate
B2B emails as well... These guys need to have the chains tightened...

I personally think that the legislation being imposed is so flawed and
unworkable that regulators will eventually change it to keep the commercial
world able to function effectively.. How this happens is yet to be seen...

They will impose a raft of methods and will cause everyone to look at
methods that fall between the cracks...

Let's take this a step further.  In my hypothetical situation, there are
four basic methods available to me for contacting you about my BBQ grill
covers:

1. Email
2. Fax
3. Telephone
4. In-person visit

Using the definition you cited from the FTC, email is out.

Fax is not an option because of the TCPA of 1991 - and there are current
efforts to put use of a Fax even more out of reach.

That leaves the telephone and in-person visits, both of which are relatively
inefficient as compared to email.

So as a result of the efforts of the few people who abuse, the rest of
business America is restricted in its use of what technology has created for
us.   And restrictions on business, not just low wages, are a primary reason
so many U.S. companies are choosing to have their operations performed
outside the U.S.   Consider California and the recent reports that 1 in 5
businesses in that state are considering moving to another U.S. state to
avoid the restrictions and expenses.

I don't like telemarketing calls in the evening or emails offering me
discount Viagra any more than other people.  But I do realize that for
every gain there is a sacrifice.  And that means restrictions on marketing
efforts put on businesses do cost me, even if they are not readily evident
to me.
