[epub] CA spam law and epublishers

Hello All,

First, let me say this is a fantastic list. I've lurked for a long while
and this is my first posting.

Yes Janet, the Congress recesses Nov 21 and I doubt they will make law that
will supercede CA's spam law by then. Heck, it's just days away. So that CA
spam law will probably go live whether we like it or not and w/ all of its
warts. The irony is that law hurts commerce and specifically hitech
commerce to which CA is so dependant. Perhaps Governor Arnold will see
that and turn it around, though I suspect he's got bigger fish to fry 
right away.

I recall seeing something recently about the DMA preparing to file an
injunction to stop the CA spam law, though why this wasn't done prior to it
becoming law is beyond me.

All of us on this list can probably show good faith which helps matters.
We're also not the big dogs who are typically the target for people who
want free money by suing. That said, we still have exposure. My guess is
the law will be challenged sooner or later. None of us want to be the
poster boy or girl for such a challenge, of course. I think it will be
overturned, held up in courts, modified, or superceded by Fed law in the
new year. In the meantime, we are in a sort of DMZ place.

We are the "white-hats" in this. In the long haul I think we'll be OK,
though challenges of signal to noise ratios worsening and such will
continue
to confront us. Hang in there brothers and sisters:).
