Under US law this persons
use of the so called trademark, which does not appear in the trademark
registration database, is fair use.
Sounds like someone out to hurt
this author.
I would send this e-mail to the
author along with the full tracking headers.
Also, try to write back to the
sender and request they provide you with proof of trademark
ownership.
