Actually, I'm finding that there are a lot of people who think CAN-SPAM is supposed to stop spam, and that compliance absolves the sender from the accusation of sending spam.

As Paul points out, that's not at all the case. The Act doesn't even attempt to stop spam.

What it does do is to prohibit spoofing, phishing (to the extent it wasn't already a crime, i.e., fraud and theft), and ignoring those unsubscribe requests.

The feds are still looking to private industry to solve the spam problem. Progress is being made but I'd say we're at least a year out from a workable solution that can be widely deployed easily.
