Okay, first I'll admit that I haven't done the required homework on CANSPAM...

So the root of my question is, does CANSPAM define "implied consent"?

I would assume that a prior "transactional" conversation allows some leeway in
the ability to assume implied consent.

What if, as part of that transactional e-messaging, I provide them with a
click-through link to opt-in to one or more publications? Then I've invited
them directly, but the burden is upon them to follow-up. I'd say that's pretty
explicit consent, right?
