One additional comment. As a Canadian, I can opine, suggest
and postulate. But, ultimately this is an American problem.

American marketers need to take control of this situation.

If you don't, then ultimately the American marketing
community has only itself to blame for the consequences.

BRAVO John, as usual you are right on target!

The initial experiment has failed. It is now appropriate for
online permission based marketers to harness the States
desires for a stronger Federal law and start lobbying the
FTC and Congress to prohibit unsolicited bulk commercial
email, (among other things).

John, of course, already knows this since he helped me write it, but for the rest of the list, iCop, in responding to the FTC's last request for comment, already lobbied them to send the CAN-SPAM Act back to Congress and ask them to rewrite the Act to PROHIBIT unsolicited BULK commercial email. They failed to do this in the CAN-SPAM Act.


The FTC hasn't updated their page of responses since we filed that, but I have it online at:

It has already been suggested to me that iCop file suit against Utah and Michigan on behalf of American online marketers. I've taken this under consideration. This MIGHT work since we are already known within the FTC, Small Business Advocacy, etc. However, it raises many issues that would need to be worked out, not the least of which is the money AND the appropriate attorney to represent us.

Nevertheless we've made a start by previously going on record as stating the reasons why the CAN-SPAM isn't working and what needs to be done to MAKE it work, thereby providing something the states wouldn't feel the need to work around.

It IS about SPAM, no doubt about that. These states are merely hiding behind so-called child protection laws to work around the CAN-SPAM Act. If they were truly concerned about child protection, they wouldn't be putting together lists all the child molesters and pedaphiles in the country are right now rubbing their hands together, waiting gleefully to access.

So, in addition to protecting the ethical online business community, somebody needs to stand up for those kids and the danger they are being put in. Possibly concerned parents in Utah and Michigan?
