I've found that peoples' memories are less than perfect
especially when meeting scores of vendors at an event,
and that a check box on a hard copy from an event
is insufficient affirmitave consent.

EZezine has implemented an "invite friends" feature
for use with potential subscribers who publishers meet an event.

After an event you enter the addresses
of folks who checked the "add me to your mailing list"
box at the event into a form.  This triggers an invitation
that can say something like "It was great meeting you
at the XYZ seminar.  You mentioned that you were
interested in subscribing to our ezine.  To confirm
your subscription click the link below."  This then
completes a web-based affirimitave consent form,
that you could lean on should a question ever come up
about a subscription.  It protects you and it protects
the subscribers.  Potential subs who don't follow through, well,
what were they likely going to do with your
ezine when it arrived?  Click the you know what
button?  Delete?  Unsubscribe?

As far as purchases and "auto-adds", I see best practice
as having a check box at point of cart-check-out. It is then in the hands of the consumer to decide whether
to be added or not.
